How old do you have to be to vape? 21 US, 18 UK
21 in the US under federal Tobacco 21. 18 in the UK, where from 29 October 2026 the age limit covers every vape, nicotine-free ones included.
You have to be 21 to buy a vape anywhere in the United States, under the federal Tobacco 21 law. In the UK the age is 18. From 29 October 2026 the UK rule covers every vape, nicotine-free ones included, in England, Wales and Northern Ireland, where until then it covers only nicotine vaping products.
That is the short answer to how old you have to be to vape, and the age limit is a rule on sale: it binds the shop, online retailers included, and in the UK it will also bind any adult who buys on a young person’s behalf. This desk read the US Food and Drug Administration’s Tobacco 21 page, the Department of Health and Social Care’s guidance on selling vaping and nicotine products, and DHSC’s media blog post on the Tobacco and Vapes Act 2026, all on 16 October 2026. Nothing below is legal advice, and every figure is the regulator’s own.

How old do you have to be to vape in the US?
Twenty-one. The FDA says that on 20 December 2019 the President signed legislation amending the Federal Food, Drug, and Cosmetic Act, raising the federal minimum age of sale for tobacco products from 18 to 21. It took effect immediately. Since then it has been illegal for a retailer to sell any tobacco product, including e-cigarettes, to anyone under 21.
Two points on the FDA page close off the usual arguments. The minimum age “applies to all retail establishments and persons with no exceptions,” and there is no carve-out for active-duty military or veterans aged 18 to 20. Asked whether states can seek a waiver for such a carve-out, the FDA answers that the law provides no exemptions.
The products covered are wider than the word “tobacco” suggests. The FDA lists cigarettes, smokeless tobacco, hookah tobacco, cigars, pipe tobacco, liquid nicotine, and electronic nicotine delivery systems including e-cigarettes and e-liquids. That puts every disposable on this desk’s beat inside the rule. On synthetic nicotine, the agency is direct: it is unlawful to sell a tobacco product containing nicotine “from any source, including non-tobacco nicotine,” to anyone under 21.
The ID rule came later. In August 2024 the FDA issued a final rule, and from 30 September 2024 retailers must check photo ID for anyone under 30 buying cigarettes, smokeless tobacco and covered tobacco products. The same rule bars vending-machine sales of those products in places where under-21s are present or allowed in.
Is it 21 to vape in every US state?
Yes, as a floor. Tobacco 21 is federal, so no state can sell below it. States and cities can add their own rules on top, and this desk did not read state statutes for this piece. The state picture moves on its own timetable; California’s disposable bill is one example, covered in California AB 762 clears both chambers.
Enforcement is the FDA’s job at the federal level. The agency says it runs compliance check inspections of tobacco retailers, both brick-and-mortar and online. The agency’s market rules are a separate question from the age limit; how authorisations work is in this desk’s piece on the FDA’s JUUL2 authorisation.
How old do you have to be to vape in the UK?
Eighteen, and the scope of that rule changes on 29 October 2026. DHSC published its guidance, “Selling vaping and nicotine products,” on 11 August 2026. Its summary line is the whole answer: from 29 October 2026, “the age of sale for all vaping and nicotine products will be age 18 and over.”
What changes depends on where you are:
- England, Wales and Northern Ireland. The current restriction applies only to nicotine vaping products. From 29 October 2026 it is replaced by an 18+ rule covering every vaping product, nicotine or not, and nicotine products such as pouches.
- Scotland. Nicotine and non-nicotine vapes are already age-restricted. From 29 October 2026 the rule also covers nicotine products.
The guidance lists what counts. Vaping products include vape devices such as vape pens, substances to be vaped such as e-liquid, and related components such as coils and vape pods. Nicotine products include, but are not limited to, nicotine pouches and nicotine strips. Batteries, chargers and electrical leads are outside it, and so are medical devices.
The legal bases differ by nation: section 10 of the Tobacco and Vapes Act 2026 for England and Wales, section 4A of the Tobacco and Primary Medical Services (Scotland) Act 2010, and article 4H of the Health and Personal Social Services (Northern Ireland) Order 1978. DHSC’s blog says the Tobacco and Vapes Act received Royal Assent on 29 April 2026.
Can you buy a non-nicotine vape under 18 in the UK?
In Scotland, no: non-nicotine vapes are already restricted. In England, Wales and Northern Ireland, the restriction that applies today covers nicotine vaping products only, and that ends on 29 October 2026. From that date it is an offence for any retailer, online sellers included, to sell any vaping product to a person under 18. The zero-nicotine shortfill or disposable stops being an exception.
What is proxy purchasing?
From 29 October 2026, the guidance says, it will be an offence for anyone aged 18 or over “to buy, or attempt to buy” vaping or nicotine products on behalf of someone under 18. The attempt counts. The same date brings two more offences: giving a vaping or nicotine product away free, or selling it at a substantial discount, where the purpose or effect is to promote it.
What are the UK penalties?
From 29 October 2026, selling to an under-18 can bring a fixed penalty notice of £200 in England, Wales and Scotland. In Northern Ireland the figure is £250, “subject to approval by the Northern Ireland Assembly”, so it is not a settled number yet. The alternative is a larger fine on summary conviction: up to level 4 on the standard scale, currently £2,500, in England, Wales and Scotland, and up to level 5, currently £5,000, in Northern Ireland. Proxy buying carries the same £200 FPN, or £250 in Northern Ireland subject to the same approval.
Do you need ID to buy a vape in the UK?
Retailers must be satisfied a customer is 18 or over, and customers “should expect to show ID” if asked. The detail is not finished everywhere. For England, Wales and Northern Ireland, regulations setting out the age-verification steps that give a retailer a defence “will be debated in Parliament in due course,” so that scheme does not exist yet. Scotland already requires retailers selling vapes to run an age verification policy, extended to nicotine products from 29 October 2026.
Why the two numbers differ
The US treats a vape as a tobacco product and set one federal floor, 21, for all of them in 2019. The UK kept 18, the same age as for tobacco, and is closing the gap around it: nicotine-free vapes, pouches, strips, free samples, proxy buyers. What the UK is not doing on 29 October is raising the age. A sale to a 17-year-old becomes an offence for products where it was not before; a sale to an 18-year-old stays legal.
The same Act reaches further later. DHSC’s blog says the government intends a ban on advertising and sponsorship of vaping and nicotine products from 1 June 2027, with secondary legislation still to be prepared. That is an intention, not a rule in force.
For what the age limit is protecting people from, this desk has covered what bystanders breathe from a vape.
Frequently asked questions
How old do you need to be to vape nicotine-free products?
In the UK, 18 everywhere from 29 October 2026. Until then, England, Wales and Northern Ireland restrict only nicotine vaping products, while Scotland already restricts nicotine and non-nicotine vapes. In the US, the FDA’s Tobacco 21 page covers nicotine from any source; the page this desk read does not address zero-nicotine vapes, and state rules vary.
What is the legal age to buy vapes in the U.S.?
21, nationwide. A federal law signed on 20 December 2019 amended the Federal Food, Drug, and Cosmetic Act and raised the minimum age of sale for tobacco products, e-cigarettes included, from 18 to 21. The FDA says it applies to all retailers with no exceptions, including no carve-out for military personnel or veterans aged 18 to 20.
What are the consequences of underage vaping?
The offences on the two regulator pages this desk read fall on sellers and, in the UK, on adults who buy for under-18s. From 29 October 2026, a UK seller faces a £200 fixed penalty notice in England, Wales and Scotland, or a fine on conviction. In the US, the FDA runs compliance check inspections of shops and online retailers.
The sources are the FDA’s Tobacco 21 page, DHSC’s guidance on selling vaping and nicotine products and DHSC’s blog on the Tobacco and Vapes Act. The UK section is written before 29 October 2026 and will be checked again after it.
Every disposable this desk covers is a nicotine product, and nicotine is addictive. These devices are for adults of legal purchase age only, 21 and over in the US and 18 and over in the UK, and not for non-smokers or former smokers.
